2014 Official Rules

Sponsored by St. Mary’s Syro-Malabar Catholic Church, Pearland, TX

St. Mary’s Syro-Malabar Catholic Church, Pearland, TX is a 501(c)(3) organization located in

Pearland, TX.

Ticket Price

The purchase price of a single raffle ticket is $100.00 each. A “purchase” shall not occur and be binding on St. Mary’s Syro-Malabar Catholic Church until funds received for the same either by cash or check which have cleared the bank. Ticket purchases are not tax deductible.

Each raffle ticket purchased and fully paid shall constitute an “entry” into the raffle, and the person to whom the raffle ticket is registered shall be the “Entrant”. The winning Entrant shall be the “winner” of the prize. The winner must supply his/her ID card before the prize is tendered. It is the sole responsibility of the Entrant to allocate a winning prize to other participants in case of a multiple entry registration, and the winning Entrant shall hold harmless St. Mary’s Syro-Malabar Catholic Church in case of conflicting claims or disputes among multiple claimants.

Quantity of Tickets

The maximum number of tickets offered for sale is 2000.

Eligibility

Purchasers of raffle tickets must be legal residents of the United States and 18 years of age or older at the time of purchase. The Entrant must supply his/her ID card to receive winning prize. If an Entrant’s check is dishonored prior to the drawing, the entry ticket will be declared invalid, until a replacement is received plus a $30.00 bank charge for return check before the draw date. Raffle tickets are non-transferrable and non-refundable; all ticket sales are final.

Taxes and Rules

Winner is responsible for any and all federal, state, and local income or excise taxes, fees, assessments, upgrades, insurance, title and like charges associated with the prize. Winner will be responsible for any or all delivery fees and/or are responsible for retrieval of their prize. The value of your winnings is considered taxable income. Please consult your financial advisor to discuss any impact on your personal taxable income. The IRS has taken the position that amounts paid for chances to participate in lotteries, raffles, or similar programs are not gifts and therefore, the price of entry does not qualify as a deductible charitable contribution. Please refer IRS Notice 1340.

Drawing

The raffle will take place on Sunday, August 17th, 2014 at St. Mary’s Syro-Malabar Catholic Church, Pearland, TX. If not sold out prior to the event, tickets will be available for purchase until the time of the drawing. Only the sold and paid tickets are put in the draw. The winner, if not present, will be notified within 7 business days. It is the responsibility of the purchaser to provide a valid, deliverable mailing address, phone and/or email address for notification. St. Mary’s Syro-Malabar Catholic Church, Pearland, TX reserves the right to change the drawing date.

Prizes

There are three prizes for this raffle.

1. The first prize is a brand new 2014 Toyota Camry Car.

2. Second prize is a round trip to India offered through Alamo Travels (Stafford, TX).

3. The third prize is a laptop computer sponsored by Mr. Justin Jose Chakkalayil (Realtor – Pearland, TX).

1. Terms and condition for First Prize (2014 Toyota Camry)

The offer is for a brand new base model 2014 Toyota Camry from an authorized Toyota dealer from State of Texas. (The car picture shown in the ticket, flyers and advertisements are only for illustration purpose. The actual car shape may vary). If the winner need an upgrade model of the car, it is between the Toyota dealership and the winner. The name of the dealership will be notified to the winner at the time of providing the winning ticket and ID card to St. Mary’s Syro-Malabar Catholic Church.

St. Mary’s Syro-Malabar Catholic Church, Pearland, TX only offer a brand new base model of 2014 Toyota Camry. All federal, state, and local income, sales, and/or excise taxes, fees, assessments, upgrades, insurance, title and like charges associated with the prize, are the responsibility of the holder of the winning ticket. Winner must complete a W-9 form before receiving prize. If fewer than 200 tickets are sold by August 17th, 2014, St. Mary’s Syro-Malabar Catholic Church, Pearland, TX reserves the right to pay one half of the collected ticket money in lieu of the car to the first prize winner.

2. Terms and condition for Second Prize (Round Trip to India)

The winner will be eligible for one free round trip air ticket to India sponsored by Alamo Travels (Stafford, TX) during offseason time. For details regarding offseason period, please contact Alamo Travels at Tel #713-557-8271. Alamo Travels will bear the cost of the ticket only and all applicable tax will be the responsibility of the winner. Any dispute arising out of these conditions, will be settled between the winner and Alamo Travels.

3. Terms and condition for Third Prize (Laptop Computer)

The winner will be given a brand new laptop computer sponsored by Mr. Justin Jose Chackkalayil (Realtor – Pearland, TX). For details regarding warranty, please contact the laptop manufacturer directly.

Notification of Winners

Winner(s) need not be present to win. Winner(s) will be notified by phone, email and/or in writing via Registered Mail of requisite procedure to claim prize according to what type of contact information provided by the winner(s), when he/she purchased the ticket. It is the responsibility of the purchaser to provide a valid, deliverable mailing address, phone and/or email address for notification. Winner(s) name will be posted at www.stmaryspearland.org within 5 calendar days of the drawing. Winning entrant is required to contact St. Mary’s Syro-Malabar Catholic Church within fourteen (14) calendar days from notification; however, winner(s) may have up to thirty (30) calendar days of draw date to finalize the process (including payment of taxes, withholding, etc). Winning entrants’ name and location by city or town and photo may be printed in selected media. If selected winning entrant is unable to be contacted or located after a period of one (1) month from the draw date, the prize will be donated to St. Mary’s Syro-Malabar Catholic Church. Three (3) attempts will be made to contact the winning entrant via Registered Mail at the address provided by the entry purchaser and via email and phone as provided.

Void Where Prohibited or Restricted by Law

This raffle is conducted in accordance with gaming laws enacted and enforced by City, State and IRS and void in areas prohibited or restricted by law. St. Mary’s Syro-Malabar Catholic Church are not responsible for lost or stolen entries. Raffle entries will be disqualified at the sole discretion of St. Mary’s Syro-Malabar Catholic Church, if attempts are made to disrupt the Raffle or circumvent the terms and conditions of these Official Rules. If the above occurs, St. Mary’s Syro-Malabar Catholic Church reserves the right to remedy any such action, disruptions, or circumvention in a manner determined solely by St. Mary’s Syro-Malabar Catholic Church that is fair and equitable to Raffle participants, St. Mary’s Syro-Malabar Catholic Church, its members, officers, directors, agents and representatives and their parent organizations, affiliates, subsidiaries, and advertising, promotion, and legal advisors are not responsible for and shall not be liable for

1. late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries;

2. failed, returned, or misdirected notification based on inaccurate information provided by the winner ;

3. telephone, electronic, hardware or software program, network, internet, or computer malfunctions, failures or difficulties resulting from participation in this Raffle of otherwise;

4. errors in transmission;

5. any condition caused by events beyond the control of St. Mary’s Syro-Malabar Catholic Church that may cause the Raffle to be disrupted or corrupted;

6. any injuries, losses, or damages of any kind caused by a prize or resulting from acceptance, possession, or use of a prize, or from participation in the Raffle ; or

7. any printing of typographical errors in any materials associated with the Raffle.

Waiver an Limitations of Liability

Entrants release St. Mary’s Syro-Malabar Catholic Church and its respective board, committee members, officers, volunteers, employees, and representative agents from any and all liability with respect to participation in the promotion and possession of the prize. Any liability of St. Mary’s Syro-Malabar Catholic Church shall be limited to the ticket price paid. In the case of a dispute, St. Mary’s Syro-Malabar Catholic Church decision shall be final.

Entrant agrees to allow St. Mary’s Syro-Malabar Catholic Church to use his/her name, and image without any compensation for any promotional activity related to this or any future raffle. Any and all addresses and contact information of the purchaser will not be released to the public.
